What is the difference between mediation & arbitration?

In mediation the parties try to resolve the dispute with the assistance of a neutral third party through a process of negotiation. In arbitration the parties appoint a neutral third party to adjudicate the matter and the arbitrator makes an award in favour of the successful party.

What is the difference between arbitration and court?

The arbitration process is less formal and shorter than the old court process. It is a professional and private process whereby a neutral third party is appointed as the adjudicator who is the arbitrator. Such arbitrator can be a specialist, expert or professional in his/her field of expertise and can be a lawyer if so required but is not a judge of court.

Mediation or arbitration?

We facilitate private mediation & arbitration which involves the poointment of an independent third party, a mediator or arbitrator, who helps both parties to reach an amicable solution or who adjudicates the matter. We also make use of new technology like video conferencing.

Normally the parties will, first, try to resolve their dispute amicably through a mediation process. If the mediation process fails, secondly, the parties will continue with an arbitration process. However, a party may elect to directly commence with arbitration. This is where the parties clearly cannot resolve their dispute amicably. For example, where one party bluntly refuses to resolve the dispute amicably or refuses to communicate with the other party.

The role of the mediator is to help parties reach a solution to their problem and to arrive at an outcome that both parties are happy to accept. Therefor the focus is to reach an amicable solution agreeable to both parties avoiding taking sides or giving judgement. They are simply responsible for developing effective communication and building consensus between the parties. Mediation is a voluntary and confidential process where the terms of discussion are not disclosed to any party outside the mediation process.

If parties are unable to reach agreement on a solution to resolve the dipute, they can continue with an arbitration process. An arbitrator will be appointed to adjuducate the matter and the arbitrator’s decision will be final and binding on the parties which may be made an order of court.

Mediation Namibia will appoint a mediator or arbitrator if the parties fail to agree on such appoinment.
